Terms of Service

These Terms govern your use of Festoso, a service of Festoso, LLC (a Florida limited liability company; "Festoso", "we", "us", "our"). The service includes the app, website, and slideshow at festoso.app. By using Festoso, you agree to these Terms.

1. The service

Festoso is a real-time shared event camera. An organizer (called the "host") creates an event; guests scan a QR code and enter a password to contribute photos and videos to a shared feed. Photos can also be displayed on a slideshow TV during the event.

2. Account types

Hosts (venue owners): create events, manage event settings, moderate content, and bill add-ons. Hosts are responsible for the content of events they create.
Guests: join an event with a QR code and a host-provided password. Guests upload photos and videos that the host has invited them to share.

3. Your content

You own the photos and videos you upload. Festoso does not claim ownership of guest or host content. By uploading content, you grant Festoso a limited, non-exclusive license to store, transmit, display, and process that content solely for the purpose of running your event — including transmitting it to other guests on the same event, displaying it on the slideshow, and producing bulk-download ZIPs for the host.

This license ends when the event's retention period expires and the content is deleted, or when you request earlier deletion.

If you are a guest: you grant the host of the event you joined the same right to view, download, and use the content you upload to that event. By joining an event, you acknowledge that the host may keep copies of your uploads outside of Festoso (for example, by exporting to their personal photo library).

4. Acceptable use

You agree not to upload:

Content you do not have the legal right to share.
Content that depicts real people who have not consented to being photographed or recorded.
Sexually explicit content, hate speech, violence, harassment, or content that violates anyone's privacy or dignity.
Content that infringes copyright, trademark, or other intellectual property rights.
Malware, spam, automation scripts, or anything that interferes with the service's operation.

You agree not to use Festoso to:

Surveil, stalk, or harass anyone.
Run an event without the consent of the people you are photographing.
Resell, sublicense, or repackage the service.
Probe, scan, or test for vulnerabilities in our systems without prior written authorization.

We may remove content or terminate accounts that violate these rules, at our reasonable discretion and in good faith.

5. Payments

One-time events (Event $34, Event Plus $59) and add-ons (AI Moderation $5, Retention Extension $10) are billed at the time of purchase via Stripe.
Pro subscriptions ($69/month) are billed monthly; overage events ($24 each above 3/month) are billed off-session when you confirm in-app.
All prices are in US dollars and exclude applicable taxes.
Refunds: we will refund any paid event or add-on before the event's scheduled start time, on request. Once the event has started — meaning a guest has joined, a photo has uploaded, or the slideshow has been opened — we cannot refund the event itself. Add-ons (AI Moderation, Retention Extension) are refundable in the same window as the event they belong to. For Pro subscriptions, we will refund the current month if you have not created an event during that billing cycle and you request it within 14 days of charge; cancellation otherwise takes effect at the end of the current period.

A Face Recognition add-on is planned for a future release; pricing will be announced when it ships. The current Festoso build does not process biometric data — see our Privacy Policy § 1 for the source of truth.

You may cancel a Pro subscription at any time from the Festoso app. Cancellation takes effect at the end of the current billing period; we do not pro-rate partial months.

6. Retention and deletion

Photos and videos are retained according to the tier you purchased — Free is 7 days, paid tiers are 90 days, and the Retention Extension SKU adds 90 days. See our Privacy Policy for details. After the retention window, content is permanently deleted and cannot be recovered.

7. App Store rules

If you obtained Festoso through the Apple App Store or Google Play, you also agree to the app store's terms. Specifically, the App Store EULA grants Apple no responsibility for the app, no warranty obligations, and no maintenance obligations — those rest with Festoso.

8. Disclaimer

Festoso is provided "as is" and "as available." We do not warrant that the service will be uninterrupted, error-free, or that all content will be preserved. We do not guarantee specific upload speeds, slideshow performance under unusual load, or AI moderation accuracy.

9. Limitation of liability

To the maximum extent permitted by law, Festoso's total liability to you for any claims relating to the service will not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater. We are not liable for indirect, incidental, special, or consequential damages — including lost photos, lost revenue, or emotional distress arising from service interruption.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability; in those jurisdictions, our liability is limited to the minimum extent permitted by law.

10. Indemnification

You agree to indemnify and hold Festoso harmless from claims arising out of (a) content you upload, (b) your use of the service in violation of these Terms, or (c) your violation of any law or third-party right.

11. Termination

You may stop using Festoso at any time. We may suspend or terminate your account if you violate these Terms or if we discontinue the service. If we discontinue the service, we will provide at least 60 days' notice and allow you to export your content before deletion.

12. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Florida, except where applicable consumer-protection law gives you the right to bring suit in your own jurisdiction.

13. Changes to these Terms

We may update these Terms. Material changes (changes to payment terms, content licenses, or dispute resolution) will be announced via email and via an in-app notice at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
